The New Trademarks Act 2019 (“TML 2019”) was signed into law on January 30e, 2019 with plans to come into force once the President of Myanmar issues the required notification. It is expected that the TML 2019 can come into force at the end of 2022.
August 28e, 2020, the Ministry of Commerce issued notification no. 63/2020 allowing the filing of trademarks which have been registered with the Registry of Deeds and Assurances (RDA) or which are used in Myanmar. The filing period (“Soft Opening Period” or “SOP”) began on October 1st2020 and will end on the effective date of the 2019 TML.
Although the effective date of TML 2019 has not been officially announced, applicants wishing to file new trademarks during the SOP (i.e. trademarks that have neither been registered with RDA nor used in Myanmar) must first register their trademark with the RDA or use them in Myanmar and then file them again during the SOP.
